     Rockwell International Charged with federal environmental crimes at Rocky Flats.

     On March 26, 1992 U.S. DOJ and Denver U.S. Attorney’s office filed their Information (charging instrument) against Rockwell International for ten (10) environmental crimes at Rocky Flats. The Information was filed after the government and Rockwell reached a plea agreement, to include a fixed fine that Rockwell agreed to pay. The Information was tendered before U.S. District Court Judge Sherman Finesilver for his consideration. Court rules allowed the Judge to decide whether he would accept the plea agreement or not. Acceptance and sentencing was scheduled in June 1992. In the U.S. District Court, District of Colorado, case number 92-CR-107. 

Filed with the Information (charging instrument) was the Plea Agreement and Statement of Factual Basis. Counts 1-4 of the Information were felonies under the Resource Conservation and Recovery Act (RCRA). Title 42, U.S. Code, Sections 6928(d)(2)(A) and (C). Counts 5-10 of the Information were misdemeanors under the Clean Water Act. Title 33, U.S. Code, Sections 1319(c)(1)(A) and 1319(c)(2)(A).
