US DOE – Fish and Wildlife Service Agreement at Rocky Flats Refuge

Pursuant to a Freedom of Information Act (FOIA) request:

On August 13, 2015 the U.S. Department of Energy (DOE) and U.S. Fish and Wildlife Service (FWS) entered into a Memorandum of Agreement (MOA) at the Rocky Flats National Wildlife Refuge, Colorado. The MOA allocates $8,315,000.00 from DOE to FWS through August 19, 2021. As of August 10, 2016 FWS has received $975,000.00.

The MOA between DOE and FWS indicates that DOE reserves much control over FWS improvements at the Rocky Flats National Wildlife Refuge. In particular, note the following:

“ARTICLE XI – PUBLIC INFORMATION
Justification and explanation of DOE-LMPs programs before Congress and other agencies, departments, and offices of the Federal Executive Branch shall be the responsibility of DOE-LM. The USFWS may provide, upon request, any assistance necessaiy to support the DOE-LM’s justification or explanations of DOE-LM’s programs conducted under this MOA. DOE-LM or the USFWS shall make its best efforts to give the otlier party advance notice before making any public statement regarding work contemplated, undertaken, or completed pursuant to lAs under this MOA.”
